Any references to other brands, including terms such as “Inspired By”, are used solely for descriptive and comparison purposes and do not indicate any association, approval, or partnership. AMARIN fragrances are independently developed and are not intended to misrepresent or infringe upon any trademarked products.
7. Product Information and Use
We make reasonable efforts to ensure that product descriptions and images are accurate; however, we do not guarantee that all content is free from errors or that colours, packaging, or presentation will appear exactly the same on all devices.
Perfume and fragrance products must be used only as intended and in accordance with any instructions provided.
8. Returns, Refunds & Exchanges
All returns, refunds, exchanges, and store credit requests are governed by the AMARIN Returns & Refund Policy, which forms part of these Terms.
By placing an order, you acknowledge and agree that:
- Change-of-mind returns are subject to the conditions outlined in the Returns & Refund Policy
- For hygiene and safety reasons, opened or used perfumes are not eligible for change-of-mind refunds
- Timeframes, eligibility requirements, and return procedures are set out in the Returns & Refund Policy
Nothing in this clause limits your rights under the Australian Consumer Law.
9. Australian Consumer Law
Nothing in these Terms or in the Returns & Refund Policy excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law (ACL).
Under the ACL, consumers are entitled to guarantees that goods are of acceptable quality, fit for purpose, and consistent with their description. If a product fails to meet these guarantees, you may be entitled to a repair, replacement, or refund depending on the nature of the issue.
Your ACL rights apply in addition to any rights outlined in our Returns & Refund Policy.
10. Limitation of Liability
To the maximum extent permitted by law, AMARIN will not be liable for any indirect, incidental, consequential, or special loss or damage, including loss of profits, data, or business opportunities, arising from your use of the Services or purchase of our products.
This limitation does not apply where liability cannot be excluded under the Australian Consumer Law.
